Terms of Service for OG Welly

Effective Date: December 1, 2025

By accessing or using OG Welly (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

1. Disclaimer of Warranties and Liability

The OG Welly application and all content, data, tools, and services provided through it, including but not limited to formation grids and algorithms, are provided “as is” and “as available” without any express or implied warranties of any kind, including, without limitation, warranties of accuracy, completeness, reliability, merchantability, or fitness for a particular purpose.

While OG Welly strives to ensure the accuracy and reliability of the information and services provided, users acknowledge that errors, omissions, or inaccuracies may occur. This includes, but is not limited to, errors in gridding algorithms, interpretation of formation tops, data processing, or software functionality.

Users agree that they use the Service at their own risk. OG Welly, its affiliates, officers, employees, or agents shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to financial losses, business interruption, or loss of data, arising out of or in connection with the use of, or inability to use, the Service or any information, tools, or services provided therein, even if OG Welly has been advised of the possibility of such damages. Users are solely responsible for independently verifying information and making decisions based on the Service’s content.

2. Account Registration

You must provide accurate, complete, and up-to-date information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful, harmful, or unauthorized purpose
• Attempt to gain unauthorized access to systems or data
• Upload or distribute viruses, malware, or other harmful content

4. Data Ownership & License

You retain all rights to any data, files, or content you upload to the platform. By using the Service, you grant OG Welly a limited, non-exclusive license to host, process, and display your content solely for the purpose of providing the Service.

We do not claim ownership of your data and do not use it for any purpose other than operating the application.

5. Subscriptions & Payments

• All payments are securely processed by Stripe. OG Welly does not store payment card information.
• Subscription fees are billed in advance at the start of each billing cycle.
• All fees are non-refundable, except where required by law.

6. Account Termination

We may suspend or terminate your access to the Service if you violate these Terms.

You may terminate your account at any time by contacting support at info@ogwelly.com. Upon termination, your data will be deleted in accordance with our Privacy Policy.

7. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes via email or in-app notice. Continued use of the Service after changes are made constitutes acceptance of the updated Terms.

8. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.
